1. Agreement to Terms

By accessing or using Clibben, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Clibben provides a digital link management and bookmarking service via a web application and browser extension. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

4. Prohibited Uses

You agree not to: (i) Reverse engineer, decompile, or attempt to extract the source code of the Clibben extension; (ii) Use the service to distribute malicious code, viruses, or spyware; (iii) Circumvent any security features or rate-limiting measures; or (iv) Use hotkeys to automate spam or harassment on third-party platforms.

5. User Content Sovereignty

You retain full ownership and intellectual property rights in the content (links, titles, and tags) you save to Clibben. By using the service, you grant Clibben a limited, non-exclusive license to store, process, and display this content solely for the purpose of providing the service to you.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Clibben and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

7. Disclaimer of Warranties

Clibben is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Pratham Singh does not warrant that: (i) the Service will function uninterrupted, secure, or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements. Your use of the Service is solely at your own risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Pratham Singh be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

Because the Service is provided to you free of charge, in no event shall our total aggregate liability for all claims related to the Service exceed ₹0 (Zero Indian Rupees). Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the courts located in Kanpur, India, and you hereby consent to the personal jurisdiction of such courts.

Users accessing the Service from outside India are responsible for compliance with their local laws. Notwithstanding the above, if you are a consumer in the European Union or other jurisdictions with mandatory consumer protection laws, you may also benefit from the protection of the mandatory provisions of the law of your country of residence.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
